End-User License Agreement

This End-User License Agreement ("Agreement") is a legal contract between you ("Licensee") and Comprobare ("Licensor") for the use of the Comprobare desktop application (the "Software"). By installing, copying or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the Software.

Plain summary: Buying a license gives you the right to run Comprobare on one workstation for one year. You can use it for any work, including paid commercial work. You can't redistribute the installer or share your license key. We provide updates during your license term and reasonable email support.

02 Grant of License

Subject to payment of the applicable fee (€100 per station per year, or the price agreed in writing for volume orders), the Licensor grants the Licensee a non-exclusive, non-transferable license to install and use the Software on the number of Stations purchased, for the duration of the License Term.

The license is granted for both personal and commercial use, including for paid project work and client deliverables.

03 Free trial

The Software may be used for a 7-day free trial on any single Station, with all features enabled. After the trial expires, a valid license key is required to continue using the Software.

05 Updates and support

During the License Term you are entitled to all updates released for the Software (bug fixes, new features and major versions). Updates may be delivered automatically or via the in-app update mechanism.

Reasonable email support is provided at support@comprobare.com on business days. Response times are best-effort and not guaranteed.

06 Activation and license validation

The Software performs periodic license validation against the Licensor's servers. The Licensee agrees that the Software may transmit the license key and a non-personal hardware identifier for this purpose. See the Privacy Policy for details.

If a license key is detected on more Stations than purchased, the Licensor may revoke or block the key after notifying the Licensee.

07 Renewal and termination

Licenses do not auto-renew. After the License Term ends, the Software will continue to open existing project files in read-only mode, and a new license must be purchased to continue creating or editing measurements.

The Licensor may terminate this Agreement if the Licensee materially breaches it (for example by sharing license keys or attempting to circumvent license validation). On termination the Licensee must cease use of the Software.

08 Refunds

Because a 7-day fully-featured trial is offered before purchase, paid licenses are non-refundable once activated, except where required by applicable consumer law. If you encounter a technical issue that prevents use, contact support@comprobare.com within 14 days of purchase and we'll work to resolve it or, if we can't, refund the affected license.

09 Intellectual property

The Software is licensed, not sold. All title, copyright and intellectual property rights in and to the Software remain with the Licensor. No rights are granted other than those expressly described in this Agreement.

Drawings, measurements and project files you create with the Software are entirely your property. The Licensor claims no ownership over your work product.

10 Disclaimer of warranties

The Software is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of measurement results, or non-infringement.

Measurements produced by the Software depend on the quality and scale of the source drawing. The Licensee is solely responsible for verifying critical figures before relying on them for procurement, construction, billing or any other consequential decision.

11 Limitation of liability

To the maximum extent permitted by law, the Licensor's total liability arising out of or related to this Agreement is limited to the amount paid by the Licensee for the Software in the twelve months preceding the claim. The Licensor is not liable for indirect, incidental, special or consequential damages, including loss of profit, loss of data, or business interruption.

12 Governing law

This Agreement is governed by the laws of Poland, without regard to conflict-of-laws principles. Any dispute arising from this Agreement shall be resolved by the competent courts of the Licensor's registered seat, unless mandatory consumer-law provisions specify otherwise.

13 Changes to this Agreement

The Licensor may update this Agreement for new versions of the Software. Changes do not apply retroactively to licenses already in effect; the version of the Agreement accepted at the time of purchase continues to govern those licenses.
